In the last three years, Alexis Zuleta (former Director of Public Tenders), has filed three successive complaints against the concession granted to PSA. Like Bernal, Zuleta also presented his complaints on his own behalf, for the "benefit of the Panamanian people."

The first claim was filed under the title: "Administrative action for the annulment of the Concession Contract A-2005-2014 of October 28, 2014, between PSA and the AMP".

On this occasion, on July 1, 2015, Zuleta filed a claim with the Third Chamber of the Supreme Court to annul the aforementioned contract. His argument was that the Panama Maritime Authority didn´t offer a public tender procedure to grant the concession, a process that, according to him, should have taken place given that the concessions are granted for public benefit and the best way to achieve this is executing a tender.





Resolution:



The Third Chamber of the Supreme Court ruled in favor of PSA, the case was dismissed and closed, since the concession law doesn´t require a public bid to grant a concession.
